Barclays Fan Fest Claw Game Instant Win Game (the “Promotion”)

Official Rules

NO PURCHASE, PAYMENT, OBLIGATION, OR FINANCIAL DISCLOSURE OF ANY KIND NECESSARY TO ENTER. A PURCHASE, PAYMENT, OBLIGATION, OR FINANCIAL DISCLOSURE OF ANY KIND DOES NOT INCREASE YOUR CHANCES OF WINNING. BY ENTERING OR OTHERWISE PARTICIPATING IN THE PROMOTION, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT REQUIRES YOU TO INDEMNIFY AND RELEASE ALL CLAIMS AGAINST THE RELEASED PARTIES AND TO AGREE TO ARBITRATION WITH NO CLASS RELIEF AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION WITH NO CLASS RELIEF.

TIMING: The Promotion begins and ends on the dates and times for each of the following two (2) Events as stated in the Timing Chart below or when prize supplies are exhausted (whichever comes first) (collectively herein after referred to as “Events”).

Entry Periods & Prize Details Chart (the “Chart”)

All dates are 2025 calendar year. All times are Central Time. 

ELIGIBILITY: The Promotion is open only to:

• legal residents of the 50 United States, including the District of Columbia (having a valid Social Security Number (SSN)).
• who are 18 years of age or older at time of entry; and
• who are a registered attendees and attend the Premier League Fan Fest at KC Live! in Kansas City, MO (the “Entrant(s)” or “Participant(s)”). 

Officers, directors, employees and agents of Barclays Bank Delaware (Barclays or the "Sponsor") its parent company, subsidiaries, affiliates, retailers, advertising and promotion agencies, The Premier League, Iris USA LLC, Marden-Kane, Inc. (the “Administrator”) and the immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and persons living in households of each, whether or not related, are ineligible. Void where prohibited or restricted by law. Sponsor reserves the right to disqualify participants who violate these official rules (the “Official Rules”) or interfere with the Promotion in any manner. If a Participant is disqualified, Sponsor reserves the right to terminate that Participant’s eligibility to participate in this Promotion. This Promotion is subject to all federal, state, and local laws. 

HOW TO ENTER/PLAY:

Step 1: Take a place in line to play the Claw Machine (the “Claw Machine”) at the Barclays booth during the scheduled/posted Fan Fest hours of operation. A Barclays Brand Ambassador (the “BA”) will provide you with an on-site Agreement (the “Agreement”) that is required to be completed prior to game play. You will need to provide your first and last name, signature, and verify that you are 18 years of age or older and have read the Official Rules. The Agreement must be signed by the Entrant prior to gameplay. Failure to comply will result in forfeiture of game play. If applicable, Entrant may designate their minor child to play on Entrant’s behalf, however, any prize won as a result of this game play will be awarded to the Entrant and not minor child. For Barclays customers only if you show proof of being a current Barclays customer to the BA, i.e., credit card issued by Barclays or savings account holder via Barclays App, you will receive priority access to the Game.

Step 2: Prior to gameplay, the BA will explain the guidelines of the Instant Win Game and provide instructions on what to do before, during and after interacting with the Claw Machine. (See Claw Machine guidelines below.)

Step 3: Use the joystick on the Claw Machine to move the crane up, down, left or right, following the guidelines set forth herein to begin gameplay. After positioning the crane correctly over the plastic sphere containing the desired prize, press the drop button. Once the Claw grabs the prize, the Claw Machine will automatically move it over and drop into the prize chute.

Step 4: The BA will retrieve the plastic sphere from the prize chute and verify the prize contained in the plastic sphere. All Entrants will proceed to the activation counter after playing the claw game to receive their prize or will receive instructions on how to claim their prize. 

Claw Machine guidelines:

• Each Gameplay (the “Gameplay”) will be set for :20 seconds to allow participants one (1) attempt to grab the desired prize before the time expires.
• The Claw Machine will be equipped with 150 plastic spheres containing prizes available.
• There is a total of 150 prizes available to be won per Entry Period.
• Before Gameplay, and after signing the Agreement, each eligible Entrant will get their event wristband checked off with a sharpie or stamp by a BA to record their turn at the Claw Machine.
• Entrant cannot tip the Claw Machine at any time during gameplay.
• Prizes dropped during play by the Claw are void.
• Entrant will be directed to stop Gameplay at the Claw Machine after time expires.
• Entrant will be awarded a prize (while supplies last), based on the plastic sphere grabbed by the claw and deposited in the receptacle (see the Prizes section below) and as verified by the BA.
• All plastic spheres contain an insert indicating the prize indicated, a green circle with a $ sign which represents the Barclays Online Savings Account prize.
• Determination of prize won is contained within the plastic sphere matching prize signage on footprint.
• All prize awards are subject to verification by the Sponsor and/or their assigns whose decisions are final and binding.
• The number of prizes available will diminish as each prize is awarded/redeemed.
• Prize restrictions apply, see Additional Conditions sections at the end of these rules.
• There is a limit of one (1) game play per person per Entry Period. 

PRIZES: The following list of prizes are available to be won at each of the Events listed above in the Timing section.

Total Approximate Retail Value of all prizes for all Events: $61,182.60.

Additional Conditions of Instant Win Prizes:

• Winners of the Barclays $2,500.00 Online Savings Accounts only:
  • Must be eighteen years of age or older and a US resident
  • Will require to complete and return an IRS Form W-9 and furnish his/her social security number that will be used only for the purpose of reporting the Winner’s prize earnings to the Internal Revenue Service, as required by law for winnings of $600 or before receiving the prize.
  • Winners will be provided with instructions to open the account online via the URL provided which must be opened within 30 days of prize notification.
  • Winner will also receive a check in the amount of $750 that may be used to assist with the payment of associated taxes. Depending upon the Prize Winner’s federal tax rate, this amount may only cover a portion of the tax liability owed. Please consult a tax professional for more information.
• If Winners of the Breeze, JetBlue, Frontier, Emirates, Wyndham Rewards and General Motors prizes do not have loyalty/rewards accounts then the Winners will need to create loyalty/rewards accounts within thirty (30) days of prize notification; Accounts can be created for free. Wyndham Rewards points must be claimed no later than (30) days after receipt of prize notification communication from Administrator. Wyndham Rewards, Inc. not responsible for any prizes that are undelivered as a result of winner’s failure to respond to such prize notification communication within such time frame. The awarding, possession and use of Wyndham Rewards points is subject to the terms and conditions of the Wyndham Rewards Program then in effect, including, without limitation, terms and conditions governing the expiration and forfeiture of such points.
• Prizes are subject to the terms and conditions, and bylaws for use and redemption will apply.
• By participating in the Promotion, Winners understand the Event may be recorded and consent to the use of their name, city/state of residence, photograph, visual and/or audio likeness for advertising or promotional purposes by Sponsor and their designees, including but not limited to the posting on Sponsor’s website and/or social media, use in advertising, without additional compensation, permission or notification except where prohibited by law.

Unclaimed prizes will not be awarded. All prizes may not be awarded. All details of prizes not specified herein shall be determined solely by Sponsor and prize provider. Except as provided herein, no cash, transfers or prize substitution is allowed except at the discretion of Sponsor, who reserves the right, where lawful, to substitute a prize (or prize component) with one of comparable or greater value. If prize cannot be awarded due to circumstances beyond the control of Sponsor and/or prize provider, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prizes are awarded but unclaimed or forfeited by recipient, prize may not be re-awarded, in Sponsor’s sole discretion. By accepting prize, Prize Winners acknowledge compliance with these Official Rules. OVERALL ODDS: Odds of winning per Entry Period for the Grand Prize: 1:30, Gap Prize: 1:30, Carnival Cruise Line Prize: 1:30, JetBlue Prize: 1:30, Frontier Prize: 1:30, Emirates Prize: 1:30, Wyndham Rewards Prize: 1:30. Priceline Prize: 1:30. AARP Credit Cards from Barclays Prize: 1:30, General Motors Prize: 1:30. Breeze Airways: 1:30, Phone Mount Prize: 1:5, Premier League Gift Coupon Code Prize: 1:6, Belt Bag Prize: 1:10, Wireless Speaker Prize: 1: 10, Power Bank Prize: 1:10. The number of instant win prizes available to be won will decrease and odds of winning adjusted accordingly during each Game Period as prizes are awarded and claimed.

GENERAL PRIZE CONDITIONS: Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. Winners are responsible for all federal, state and local taxes as well as all costs and expenses associated with prize acceptance and use not specified herein as being awarded. A full list of prize conditions will be furnished onsite upon request or at time of prize award. Limit of one prize per person, per Entry Period.

WINNER NOTIFICATION: Potential Grand Prize Winners will be notified via email within three (3) business days of prize verification. Potential Prize Winners will be required to complete, sign and properly execute [1] an Affidavit of Eligibility and Liability/Publicity Release (where applicable by law) (collectively the “Affidavit”) and [2] an IRS Form W-9, all of which must be returned within the time allotted. If a potential Winner refuses the prize, they forfeit all rights to be deemed a winner in the Promotion and will be disqualified. If the prize is won by an eligible individual who is not of the legal age of majority in the state of residence (minor), the required documents must be confirmed and signed by winner’s parent or legal guardian, and the prize will be awarded in the name of their parent or legal guardian, who will be required to fulfill all requirements imposed on the winner set forth herein. Prizes must be accepted as awarded. Except where prohibited by law, the Winner’s acceptance of the prize constitutes permission for the Sponsor to use said Winner’s name, photograph, likeness, statements, and biographical information without further compensation. All other Winners will be required to complete an affidavit of eligibility onsite to claim a prize. Affidavits must be signed by the Winners prior to receiving a prize. Failure to comply will result in forfeiture of prize.

GENERAL CONDITIONS: By entering the Promotion, Entrants, or, if minor in their state of residence, their parents or legal guardians, agree to the use by Sponsor and its designees of their names, cities and states of residence and photographs/likenesses, including but not limited to the posting of Winner’s name on the Sponsors website(s), in a Winners List or other online announcements for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, notification, or permission, except where prohibited by law. Upon request, Winners must consent to such in writing. Participants release and hold harmless Sponsor, The Premier League, participating prize partners, their respective parent companies, affiliates, subsidiaries, retailers, advertising and promotion agencies, Iris USA LLC, Marden-Kane, Inc. (collectively, the “Releasees”) and their respective employees, officers, directors and shareholders from any claims, actions, injury, loss or damage of any kind resulting from participating in this Promotion or from the acceptance or use of any prize awarded. U.S. law governs this Promotion. Releasees are not responsible for incorrect or inaccurate transcription of entry information, or for any human or printing error, technical or mechanical malfunctions, omission, interruption, deletion, defect, computer equipment, software, inability to access any online service or website, inability to submit the online registration form/Waiver, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer or personal device related to or resulting from participation or downloading any materials in this promotion or Barclays emcee/BA’s, attendees and other noise associated with the event impacting Entrants performance. Entry materials that have been tampered with or altered are void. If, for any reason, the Promotion is not able to run through completion for reasons which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, including any other factors beyond Sponsor’s reasonable control such as a Force Majeure (e.g., war, riots, terrorism, civil unrest, strikes, blackouts, supply shortages, order of governmental authority,) an “act of God” (e.g., natural disasters, weather, etc.) or an unforeseeable health event (e.g. pandemic or epidemic), then the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion in whole or in part, without further liability to the Entrants or third parties. In the event the Promotion is cancelled prior to the stated end date, a notice will be posted on site; and Sponsor reserves the right to award prizes from among all eligible non-suspect Entries received prior to the time of the action or event warranting such cancellation. Caution: Any attempt by a participant or any other individual to deliberately damage or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.

PRIVACY: Information collected from entrant is used only for the purpose of the prize drawing, to notify winners, and fulfill prizes, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless entrant has opted-in to receive additional information and promotional material from Sponsor or a third party. By participating in the Promotion, Participant hereby acknowledges that they have read and accepted Sponsor's privacy policy located at BarclaycardUS.com.

PLEASE READ: IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION. These Official Rules contain terms that govern how claims relating to this Promotion will be resolved. For example, they include an arbitration agreement and waiver of a class action that require submitting Promotion-related claims to an arbitrator (instead of going to court before a judge or jury). They also limit the ability to bring claims on behalf of other persons (that is, it prohibits bringing any class action or collective or representative proceeding). The Official Rules also limit the type of damages that can be recovered. Please read these terms carefully as they impact your legal rights and, by participating in the Promotion, you are agreeing to the terms.

DISPUTES AND CHOICE OF LAW: This Promotion is only offered in the fifty (50) Unites States and D.C. and is governed by the laws of the State of Delaware. Sponsor's failure to enforce any terms of these Official Rules shall not constitute a waiver of that or any other provision. By entering, Entrants irrevocably consent to the dispute resolutions stated below as well as to the sole and exclusive jurisdiction of the courts of the State of Delaware in a county determined by the Sponsor for any action, suit or proceeding arising out of or relating to this Promotion. Entrant agrees that any claim or dispute at law or equity that has arisen or may arise relating in any way to or arising out of the Promotion, the Official Rules, or the Sponsor’s and/or Administrator’s Privacy Policy will be resolved in accordance with the provisions set forth in this Dispute Resolution section. Please read this section carefully. It affects your rights and will have a substantial impact on how claims you and we have against each other are resolved. Entrant agrees that whenever you have a disagreement with Administrator or Sponsor arising out of, connected to, or in any way related to the Promotion, the Official Rules, or the Sponsor’s and/or Administrator’s Privacy Policy, you will send a written notice to the Sponsor (“Demand”). Entrant agrees that the requirements of this Dispute Resolution section will apply even to disagreements that may have arisen before Entrant accepted these Official Rules or the Sponsor’s and/or Administrator’s Privacy Policy. Entrant must send the Demand to the following address (the “Notice Address”): Barclays Bank Delaware, 125 S. West Street, Wilmington, DE 19801, Attention; Legal Department. Entrant agrees that Entrant will not take any legal action, including filing a lawsuit or demanding arbitration, until 10 business days after Entrant sends a Demand. If the disagreement stated in the Demand is not resolved to Entrant’s satisfaction within 10 business days after it is received, and Entrant intends on taking legal action, Entrant agrees that it will file a demand for arbitration with the American Arbitration Association (the “Arbitrator”). This arbitration provision limits the ability of Entrant, Administrator, and Sponsor to litigate claims in court and Entrant, Administrator and Sponsor each agree to waive their respective rights to a jury trial or a state or federal judge. Entrant agrees that it will not file any lawsuit against Administrator or Sponsor in any state or federal court. Entrant agrees that if it does sue in state or federal court, and Administrator or Sponsor brings a successful motion to compel arbitration, Entrant must pay all fees and costs incurred by Administrator and Sponsor in court, including reasonable attorney’s fees. For any such filing of a demand for arbitration, Entrant must affect proper service under the rules of the Arbitrator and notice to the Notice Address may not be sufficient. If, for any reason, the American Arbitration Association is unable to conduct the arbitration, Entrant may file its case with any national arbitration company. The Arbitrator shall apply the AAA Consumer Arbitration Rules effective September 1, 2014 (and as may be amended) and as modified by the agreement to arbitrate in this Dispute Resolution section. Entrant agrees that the Arbitrator will have sole and exclusive jurisdiction over any dispute it has with the Administrator or Sponsor. The Federal Arbitration Act allows for the enforcement of arbitration agreements and governs the interpretation and enforcement of the agreement to arbitrate. The place of arbitration shall be Delaware, County, New Castle. Entrant agrees that it will not file a class action or collective action against Administrator or Sponsor, and that Entrant will not participate in a class action or collective action against them. Entrant agrees that it will not join its claims to those of any other person. Notwithstanding any other provision in the Official Rules, or the Sponsor’s and/or Administrator’s Privacy Policy, if this class action waiver is invalidated, then the agreement to arbitrate is null and void, as though it were never entered into, and any arbitration dispute at that time will be dismissed without prejudice and may be refiled in a court. Under no circumstances does Entrant, Administrator, or Sponsor agree to class or collective procedures in arbitration or the joinder of claims in arbitration. Administrator and Sponsor agree that we will submit all disputes with Entrant to arbitration before the Arbitrator. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor’s in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules (whether of the State of Delaware or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Delaware. This arbitration provision shall survive conclusion, modification or termination of the Promotion and suspension, revocation, closure, modification, or amendments to the Official Rules, and any aspect of the relationship of the parties relating to or arising from participation in the Promotion.
